NightFun (operated by Eclipzion) provides technology and operations services only: software for organizing private gatherings — invitations, RSVPs, timed address sharing, door check-in, and related coordination tools. NightFun is not the organizer, promoter, venue, security provider, or supervisor of any event, and is not a party to whatever happens at one. Guests never need an account to attend — the invite link works on its own; a guest account is an optional way to see your invites in the app, and these terms apply to it the same way.
You must be at least 18 years old — or the age of majority in your jurisdiction, whichever is higher — to create an account or use NightFun, as a host or as a guest. By creating an account, or by accepting an invite through the app, you represent that you meet this requirement. NightFun does not knowingly permit anyone under this age to use the service; an account found to violate this may be suspended or removed.
Every event coordinated through NightFun is organized, controlled, and hosted solely by its host. The host — not NightFun — is responsible for the venue and its condition, the guest list, safety and capacity, security, food and drink (including alcohol service and age verification), permits, insurance, and compliance with all applicable law. NightFun does not inspect venues, vet hosts or guests, or supervise events.
By creating an account — host or guest — and by attending or hosting any event coordinated through NightFun, you agree, to the maximum extent permitted by the law of [JURISDICTION]:
Assumption of risk. Attending or hosting private gatherings carries inherent risks — including but not limited to personal injury, illness, property damage or loss, and the acts or omissions of other attendees. You attend and host voluntarily and assume these risks yourself.
Release. You release Eclipzion, its owners, officers, employees, and agents from any claim, demand, liability, or damages of any kind arising out of or connected with any event coordinated through the service — including claims arising from the conduct of hosts, guests, or third parties — except to the extent caused by NightFun's own gross negligence or willful misconduct, or where such a release is not permitted by law.
No duty to monitor. NightFun provides coordination software and does not undertake any duty to monitor, prevent, or intervene in events or in conduct at them.
Indemnity (hosts). If you host, you agree to indemnify Eclipzion against third-party claims arising from your event, to the extent caused by your acts or omissions as its organizer.
Recorded at sign-up: the app requires explicit agreement to these terms — including this section — before an account is created, and keeps a per-version record of that agreement.
Don't use NightFun to harass, to record people who've asked to be removed, to sell access to strangers, or for any unlawful gathering. We may suspend accounts that do.
Optional paid membership is billed through your Apple ID as an annual auto-renewing subscription; manage or cancel it in your device's subscription settings. Core hosting features remain free.
The service itself is provided as-is to the maximum extent permitted by the law of [JURISDICTION]; our aggregate liability connected with the service is limited to the greater of the fees you paid us in the past twelve months or the minimum amount required by law.
